Terms of Service

These Terms of Service govern your use of denkr, a local-first AI assistant mobile application, and the denkr website. denkr is currently beta software. Please read these terms carefully before using the app.

1. Operator

denkr is operated by Mohammed Reschreiter, Austria. Contact details are provided in the legal notice/imprint.

2. Local-first tool, not a managed assistant service

denkr is provided as a software tool. The app is designed so chats, memories, notebooks, reminders, profile data, images, and logs are stored mainly on your device. The developer does not operate a central chat account for you and does not have access to your local app database.

Because denkr is decentralized and local-first, the developer cannot remotely inspect, delete, recover, or edit your local data and cannot turn off the app for a specific user installation. You are responsible for your device, backups, exports, provider connections, and local content.

3. User-created assistant persona and instructions

denkr lets you configure the assistant's persona, tone, memory guidance, prompts, and instructions. You are the creator and controller of that assistant persona. Any behavior, wording, character, tone, or personality resulting from your prompts or system instructions is your responsibility.

You may not configure or use the assistant to generate unlawful, abusive, exploitative, violent, infringing, deceptive, or otherwise prohibited content.

4. Third-party AI providers and output

AI responses are generated by external model providers such as Google Gemini, OpenAI, or other providers you choose or connect. denkr sends your request content to those providers only when needed to perform the action you request.

The developer does not control third-party model output and does not guarantee that AI responses will be accurate, complete, safe, lawful, non-offensive, current, or suitable for your situation. You must review outputs before relying on them, publishing them, or acting on them.

5. No professional or emergency advice

denkr is not a substitute for medical, legal, psychological, financial, emergency, or other professional advice. Do not rely on denkr for diagnosis, treatment, legal decisions, financial decisions, crisis intervention, emergency response, or safety-critical choices.

If there is immediate danger, self-harm risk, suicidal ideation, violence, a medical emergency, or another urgent safety issue, contact local emergency services or qualified crisis support immediately.

6. Prohibited use

You must not use denkr to:

  • Plan, assist, conceal, or encourage illegal activity under Austrian, EU, or other applicable law
  • Incite violence, abuse, harassment, exploitation, discrimination, or self-harm
  • Create, store, or distribute unlawful, infringing, deceptive, or prohibited content
  • Bypass provider safety rules, access controls, or legal restrictions
  • Violate the rights, privacy, or security of another person

7. Beta status and availability

denkr beta may contain bugs, data-loss risks, incomplete features, provider interruptions, and compatibility issues. Features may change, break, or be discontinued. To the extent permitted by law, denkr is provided without warranties of uninterrupted availability, fitness for a particular purpose, or error-free operation.

8. Liability

To the extent permitted by applicable law, the developer is not liable for damages arising from user-created assistant personas, user prompts, third-party AI output, provider outages, inaccurate responses, offensive or harmful generated content, local data loss, user exports, or user-selected integrations.

Nothing in these terms excludes liability that cannot be excluded under mandatory Austrian or EU law, including liability for intent or gross negligence where applicable.

9. Privacy and provider terms

Local app data is mainly stored on your device. However, messages, files, images, memory context, notebook context, or tool context may leave your device when you ask denkr to send them to a connected AI provider or external service. Those providers process data under their own terms and privacy policies.

You must only connect providers and send content if you accept the privacy and security risks of those providers.

10. Changes

These terms may change as denkr evolves. The "Last updated" date reflects the current version. Continued use after a change means you accept the updated terms where legally permitted.

11. Governing law and jurisdiction

These terms are governed by Austrian law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Where legally permitted, the exclusive place of jurisdiction is Vienna, Austria.

12. German summary / Deutsche Zusammenfassung

denkr ist eine lokal-first Beta-App. Die wesentlichen Daten bleiben auf Ihrem Gerät. Der Entwickler hat keinen Zugriff auf Ihre lokalen Chats, Erinnerungen, Notizen, Bilder oder Protokolle. Sie erstellen und kontrollieren die Persona und Anweisungen des Assistenten selbst und sind fuer Ihre Prompts, Inhalte und Nutzung der KI-Ausgaben verantwortlich.

KI-Antworten werden von Drittanbietern wie Google Gemini, OpenAI oder anderen verbundenen Anbietern erzeugt. denkr ersetzt keine medizinische, rechtliche, psychologische, finanzielle oder Notfall-Beratung. Bei akuter Gefahr, Selbstverletzungsrisiko oder einem Notfall wenden Sie sich sofort an Notrufdienste oder qualifizierte Krisenhilfe. Es gilt oesterreichisches Recht; soweit zulaessig, ist Wien Gerichtsstand.
